High Court Police Protection for Couples in Rajasthan

Under Article 21 of the Constitution of India, every major individual has the fundamental right to life, liberty, and the freedom to choose their life partner. In Rajasthan, couples who marry against familial or community wishes frequently encounter severe threats. 1. The Prerequisite: Valid Marriage Documentation

Before moving the High Court for security orders, the couple must establish their legal majority and the validity of the marriage:

  • Age Verification: Groom must be 21+ and Bride must be 18+ (verified via 10th mark sheets or birth certificates).
  • Marriage Proof: A legally recognized marriage certificate (such as an Arya Samaj certificate followed by court registration, or a Special Marriage Act certificate).

2. Filing a Protection Petition in the Rajasthan High Court

Protection matters are filed before either the Principal Seat at Jodhpur or the Jaipur Bench, depending on district jurisdiction:

  • Writ Petition under Article 226: An advocate files a petition before the High Court detailing the threat to the couple's life and liberty from specific family members or community groups.
  • Court Directions: Upon reviewing the age proofs and marriage certificate, the High Court issues direct orders to the Superintendent of Police (SP) and the local Station House Officer (SHO) to ensure the couple's safety and prevent unauthorized harassment.

3. Informing Local Police Authorities

Concurrently, a formal written representation attaching the marriage certificate and ID proofs is submitted to the relevant SP and SHO offices. This officially documents the threat perception on police records.
