NRI Court Marriage in Punjab & Rajasthan

Due to high emigration rates from Punjab and Rajasthan, marriages involving Non-Resident Indians (NRIs) are extremely common. To ensure the marriage holds up internationally for spouse visa applications, the registration process requires strict adherence to legal documentation.

1. The Punjab Registration of Marriages Act

In Punjab, registering an NRI marriage has specific safeguards to protect local citizens from fraudulent marriages. The marriage must be registered with the local Registrar of Marriages under the relevant state laws, often immediately following a traditional Anand Karaj or Hindu ceremony.

2. Crucial Documents for the NRI Partner

The standard age and ID proofs apply, but an NRI or foreign citizen must provide additional documentation:

  • NOC/Marital Status Certificate: A No Objection Certificate from their embassy or home country proving they are single/divorced and legally free to marry.
  • Passport & Visa: Copies of a valid passport and the visa on which they entered India.
  • Apostille Stamp: Any divorce decrees or death certificates of a former spouse issued outside India must carry an Apostille stamp to be legally valid in Indian courts.

3. Special Marriage Act (For Foreign Citizens)

If the visiting partner has given up their Indian citizenship and holds a foreign passport, the marriage is often processed under the Special Marriage Act. This requires a 30-day notice period. Proper planning is essential to ensure the foreign partner's visa remains valid throughout this mandatory waiting period.
