Inter-State Marriage: Registering Across Rajasthan & Punjab

When a couple belongs to two different states—for example, the groom is from Punjab and the bride is from Rajasthan—deciding where and how to legally register the marriage often causes confusion. Jurisdictional rules strictly dictate where a marriage application can be filed.

1. The Rule of Jurisdiction

Under Indian law, an inter-state couple has three valid options regarding where they can legally file for marriage registration:

  • Where the Groom Resides: The district in Punjab where the groom has permanent or established residency.
  • Where the Bride Resides: The district in Rajasthan where the bride resides.
  • Where the Ceremony Took Place: If the couple decides to host their traditional wedding or Arya Samaj ceremony in a neutral or third district, the marriage can be registered there, provided proper ceremony proofs are submitted.

2. Addressing the Notice Period (Special Marriage Act)

If the couple is marrying under the Special Marriage Act (e.g., an inter-faith marriage), the "Notice of Intended Marriage" must be given to the Marriage Officer of the district where at least one party has resided for the last 30 days. Interestingly, a copy of this notice will also be sent to the Marriage Officer of the other partner's home district to be publicly displayed.

3. Document Coordination

Inter-state registration requires meticulous document coordination. The couple must provide:

  • Separate address proofs confirming their respective home states (Aadhaar or Voter IDs).
  • Notarized affidavits drafted specifically to address the inter-state nature of the application.
  • Witnesses, ideally split between the two states to avoid technical objections from conservative registrars.
